Employment agreements
Drafting, reviewing and negotiating employment agreements to ensure compliance with Ontario’s employment standards legislation, including the Employment Standards Act, 2000 and the Canada Labour Code, and common law principles. This includes terms related to: Compensation, Benefits, Termination, Unjust Dismissal, Non-Compete Clauses and Confidentiality Agreements.

WRONGFUL DISMISSAL
I represent employees who believe they have been wrongfully terminated or constructively dismissed, and advise employers on their legal obligations when terminating employees, whether they be provincially or federally regulated. This may involve negotiating severance packages or pursing legal action through the courts or tribunals in Ontario.

HUMAN RIGHTS ISSUES
I provide advice and support on human rights matters, including discrimination, harassment, and accommodation based on protected grounds under the Ontario Human Rights Code. In this regard, I can help both employers and employees navigate human rights legislation and resolve disputes, whether through negotiation or legal proceedings.
EMPLOYErs
Workplace policies and procedures
Assisting employers in developing and implementing workplace policies and procedures that comply with Ontario’s employment standards, occupational health and safety regulations, and human rights legislation. This includes policies related to harassment prevention, accommodation, confidentiality, and disciplinary procedures.
Employment Standards Compliance
I assist employers with compliance issues related to Ontario’s Employment Standards Act, 2000, including matters such as minimum wage, overtime pay, hours of work, vacation entitlements, and leaves of absence.
Employee benefits and pension plans
I regularly advise employers on the design, implementation, and administration of employee benefit plans and pension agreements in compliance with Ontario’s pension and benefits legislation.
Restrictive covenants
I advise employers on the enforceability of restrictive covenants such as non-compete agreements, non-solicitation clauses, and confidentiality agreements. As well, I can also assist with drafting, enforcing, and challenging restrictive covenants to protect the interests of both employers and employees.
Transactional work
If you are thinking of buying or selling a business, I can assist with conducting due diligence and ensuring the smooth transition of employees from one entity to another, along with enforceable employment agreements to govern the relationship.

During the initial consultation, I will listen attentively to your account of events, review any relevant documentation such as employment agreements and termination letters, and offer an initial evaluation of your matter.

I conduct a detailed legal analysis to determine the merits of your matter. This involves examining applicable employment laws, contractual agreements, company policies, and case law relevant to the issues.

Based on the facts and information gathered, I develop a strategic plan tailored to the client’s specific situation. This may include negotiating with the employer or employee on your behalf in an attempt to resolve the matter without the need for costly litigation, pursuing mediation, or preparing for litigation and proceeding through the court process.
